Does anyone know the copyright laws on digitally altered photographs?
I am looking at doing a series on photos that would have been taken around the 1930's. Significant alterations will be made...but, obviously, the photos aren't mine.
At what point does a photo become public domain?
Do the alterations made digitally create a new work...or does the fact that the work is based in someone elses ORIGINAL negate the idea that a new work has been created?
I am a great believer in copyrights by the way...and would like to know what the law is. |

Tell me if you figure it out: http://www.copyright.gov/help/faq/faq-duration.html#duration
The way I read it, work produced prior to 1978 has a copyright of 28 years, however it could be renewed up to 75 years post publication/creation.
Now if you alter the image substantially, that may make for “fair use” appropriation of a copyrighted image. |
