From what i see from the picture, the background splatters you could do with photoshop brushes, but for the character i'm only assuming you'll have to draw and colour it yourself, shouldn't be to hard if you've got a graphics tablet.

The bg definately looks like a splatter brush and the figure could be a drawing or a photo with a sketch or watercolor filter applied.
