tricky cloning problem

I have a major cloning problem that I need to solved because I keep running into the same problem.

I have some photos where the subject is in front of something I need to clone out. The subject is a dog standing in front of someone's leg. I am trying to clone out the leg.

I tried to use a layer mask, but it seems like no matter what I paint (subject or background) the clone always ends up on the subject.

I also tried using the magnetic lasso to select the subject, then paste into a new layer, then cloned the layer underneath. This leaves a very harsh line where the selection was made. It doesn't look real or natural.

My big question is....how can I cleanly clone something without getting the clone on the subject?

Try cutting out the dog using the pen tool then load path as selection. Once u have marching ants and marquee tool selected then refine edge button to get rid of harsh line.

Where would I find the refine edge button?

Select>Refine Edge. When you have the selection (marching ants) selected.
