Resized photos not acting the way I expect

I have my own photo galleries, and on each photo I stick my URL in the bottom corner. Great with PS CS3 to use the actions.

My photos are taken with different cameras hence the original sizes are different. First off I use Photoshop to resize them all to 800x600 then run an action on them all which puts on the text layer, adds a bit of fancy stuff such as drop shadows, then sizes and positions them in the bottom right corner.

Even though all the photos are the same size at this point, PS seems to screw up positioning the text layer - on some photos I get it saved correctly, then on others it might be really big across the entire photo, on others maybe really small in the middle. Is there something I am doing wrong or is PS just remembering some how the original sizes of the photos?
