This tool cuts out your desired shape of your photo
but there is no shape for the rounded rectangle shape?
any ideas on how to do this ?

the rounded rectangle shape, is the shape.
click and drag to size or set size to your needs
if this is what you mean

The rounded rectangle tool is what you want to use (the one you are pointing to at the bottom). It's not on the custom shape menu as it has options, but it is a rounded rectangle shape.

I have never seen the cookie cutter tool where is it? i did a search in CS3........nothing

Lol, I'm no that ritch that I can pay out £850, for software, but I will do it's better that way as it cost the software company a lot of money to make a software, and I'm guessing PS is just one of the high costing development software, so theprice is worth it.
Now if your talking about there support, well let's not go there as well it's not there really 22 day's at the moment for help tomorrow it's goingto be 23 day's lol
